Debt collection: effective procedures

Recovering a debt isn't always easy, but there are legal avenues that allow you to effectively claim what you're owed. The key is to act promptly and with legal support.

The summary proceeding is the most agile. It requires a document proving the debt (invoice, contract, etc.). The court notifies the debtor, who has 20 days to pay or file a claim.

If the petitioner fails to respond, a court order is issued, allowing for the seizure of accounts, wages, or assets. If there is opposition, a verbal or ordinary trial is opened, depending on the amount claimed.

Before going to trial, and although it has always been advisable, it is now necessary to attempt amicable negotiation before going to court, using any of the methods permitted by law. Sometimes this is sufficient to obtain payment without litigation.
